Community Justice: Innovation and Equity in Bolivia

Bolivia is a global benchmark in human rights by recognizing Legal Pluralism with equal legal hierarchy.
In our country, two systems with the same constitutional rank coexist: ordinary justice (heir to Roman-Germanic law that Europeans know well.) and the Indigenous Native Peasant Jurisdiction (JIOC).

Far from competing, both systems complement each other to guarantee democratic, rapid and culturally suitable access to justice.

Since the 2009 Constitution, both systems have the same legal status and neither is subordinate to the other.
To avoid clashes, the Law of Jurisdictional Demarcation clearly delimits the competences of the indigenous justice.
This only applies to members of the people, within their ancestral territory and for community offenses.
